General Terms and Conditions

Dear clients,
we are very pleased about your interest in working with us! We treat your order and all communication within the scope of the order confidentially. To ensure the best possible collaboration, we attach great importance to transparent and clear communication in order to maximize the added value from our collaboration .
For individual agreements, missing provisions, or other questions or concerns, we are available to discuss your needs personally.

The following lines contain the General Terms and Conditions (GTC) governing the cooperation between our clients (referred to in this document as "clients") and us, the company greg.design by Gregory Anthony Zagkos, referred to in this document as GD .


1 Definition of services

GD is committed to the objective and goal-oriented implementation of graphic design services: order preparation and planning, consulting, coaching and training, identity development in visual communication, research, sketches, concept development, detailed design, execution, realization and production monitoring.


2 Offer & Order

2.1 Offer

Our offers are fair, transparent, and tailored to the client's brief. We are happy to explain all positions to ensure a shared understanding.

Offers are indicative and generally valid for 10 days. Subsequent changes (see 2.3) will be charged separately.

2.2 Placing and confirming orders

An order is considered placed upon written confirmation or a down payment, also via email or text message. Acceptance of our terms and conditions is indicated upon placing the order; a signature is not required.

2.3 Author proofreading

Additional services not offered (e.g. subsequent text or image changes) are subject to a charge as author corrections and are billed according to the effort involved.  

Author corrections include data, documents and templates that are incorrect or do not correspond to the offer, as well as additional texts, subsequent text changes, texts that have to be manually transcribed or reformatted, additional or subsequent editing, additions, above-average shipping and brokerage work, as well as correspondence with third parties, etc.

2.4 Payment terms

Unless otherwise agreed, invoices are payable within 10 days; after that, interest on late payment will be charged.

2.5 Duty to cooperate

Clients shall support GD by providing the necessary information in a timely manner. Additional costs resulting from delays will be charged.

2.6 Reduction or cancellation of the order

In the event of a reduction or cancellation, GD is entitled to compensation for the work performed, any costs incurred, damages, and the right to use the work previously performed for other purposes. The rights of use remain with GD.

2.7 Project completion

A project is considered complete upon handover and full payment. Digital results are optimized according to current standards, but 100% perfection cannot be guaranteed. Data will be made available upon request for a fee.

2.8 Notice of defects

The client shall check the services received immediately and report any defects within 8 days in writing or by telephone, otherwise the right to correction shall be forfeited.

2.9 External services & work by third parties

Third-party services, purchases, and services are generally billed to the client, possibly with an appropriate surcharge for organizational costs. GD's quotes are generally exclusive of third-party costs.

2.10 Additional performance

Deviations from the agreed effort as well as additional requests during the course of the project will be invoiced separately.

2.11 Handling your data

Our clients’ data is treated confidentially and protected as best as possible.

2.12 Storage of documents

GD retains project data for at least one year after completion. Longer retention periods can be agreed upon in writing; for larger projects, pro rata storage costs apply.

3 Intellectual Property

3.1 Copyrights and rights of use

All works created by GD remain protected by copyright. Upon full payment of the fee, the client receives the perpetual right to use the works for the specified scope. This excludes creation and original files (see 3.6).

3.2 Extensions and adjustments

GD welcomes further developments of created works. Adapted works may only be published after consultation with GD and under the terms agreed upon in each individual case. We are happy to implement these changes for our clients. This is the only way GD can guarantee the best possible quality for every desired use.

3.3 Attribution and reference

GD appreciates the visibility of authorship. Unless otherwise agreed, GD may display its logo or name in an appropriate manner or be mentioned in the client's imprint.

3.4 Works in progress

Drafts, rough versions, and variants not approved for final use remain the property of GD and may not be reused, modified, or published in any form without prior consultation. The release of such unfinalized works will only occur upon express consent and under the conditions agreed upon in each individual case.

3.5 Sample copies and references

GD welcomes a copy of any published work and reserves the right to use the work for reference or promotional purposes. If publication is not desired, a brief note is sufficient.

3.6 Creation and original files

The original files and creation data created during the project remain the property of GD and are not released by default. The client receives the final versions released for the agreed-upon use.

We will gladly release the original files upon request or under agreed terms. Without such an agreement, all rights to the creation files remain with GD.


4 Use of order data

4.1 Data protection

GD treats all personal data in accordance with Swiss data protection regulations and only discloses it when legally obliged to do so.

4.2 Warranty

GD assumes that the client is authorized to submit third-party materials (texts, images, etc.) for processing. Should third-party rights be infringed, this is the sole responsibility of the client, who will indemnify GD.

5 Disclaimer

GD is only liable for direct damages resulting from intentional or grossly negligent conduct and assumes no liability for indirect damages, consequential damages, or lost profits. Further risks are borne by the client. Liability excludes claims for direct or indirect damages caused by defects, unless gross negligence is involved.

The client is responsible for technical aspects such as domain and email transfer, hosting, and other digital services. GD typically only handles design, layout, and simple setup tasks, but is happy to support clients with setup and training, or as agreed upon in the services. Work on existing services, websites, or templates is performed at the client's own risk.

GD only works for competitors of the client unless a direct competitive situation has been explicitly communicated and
particular concerns arise as a result.

5.1 Disclaimer of liability for work with third parties

GD may, either itself or on behalf of the client, commission third parties (e.g., printers, freelancers) or engage them as subcontractors. GD assumes no liability for failures or defects of suppliers. Suppliers are selected based on experience, but no guarantee is given for their availability or quality.

5.2 Extended Disclaimer

GD assumes no liability beyond the value of the services provided. Liability for indirect, consequential, or lost profits is expressly excluded, except in cases of intent or gross negligence.


6 Applicable law and place of jurisdiction

The contractual relationship is governed by Swiss law. The place of jurisdiction is Bern. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by a provision that reflects the intended purpose.
